TERMS AND CONDITIONS - PURCHASE AND DELIVERY - KILMANINSTITUTET

INTRODUCTION
Current general terms and conditions (“the Terms & Conditions”) for purchase and delivery of products from FRIWAY AB via www.friway.se (“the Website).

The terms and conditions are valid in respect of purchases by an individual customer for private consumption as well as purchases by a corporate entity such as a commercial company. Certain terms listed below are not valid for corporate customers. This will be evident by the context of the terms and conditions.
The terms and conditions are constructed according to Swedish Consumer Law (Konsumentköplagen 1990:932). The regulations apply to the Buyer as well as the Seller.
Any disputes are subject to Swedish Law.

1. PRICES
Prices are quoted inclusive of tax (mervärdesskatt). All prices exclude delivery unless otherwise stated. We cannot accept responsibility for any inaccuracies or changes to our prices beyond our control. Products in stock at the time of order are delivered at the price agreed at the point of order.  Should the price change between order and delivery, the price quoted at the time of order is still valid.

For any product, which at the point of order is out of stock, the price confirmed at the point of order is still valid, but we reserve the right to change the price in case of any adjustments to the cost by a manufacturer or other circumstances beyond our control. Should the price be adjusted after the point of order, the buyer must approve the new price before delivery, otherwise the order is cancelled.

2.  ORDERING
To make an order on the Website the Buyer places the product in the shopping basket and proceeds to provide the requested details. This constitutes an order and as a result a purchase has been made.

For deliveries within Sweden, telephone orders to 08-600 05 50 or orders by email to info@friway.se are also accepted. With regard to telephone and email orders, the Buyer should provide name, their personal identification number (‘personnummer’ - in order to send invoices via Klarna), address, mobile phone number and the requested products. If you order from outside Sweden only debit and credit cards are accepted as payment method. For email and telephone orders, allow extra processing time.

3.PAYMENT
Purchases made via the Website are invoiced via Klarna invoice/part payment system or DIBS card payment. For deliveries to addresses outside Sweden, only debit and credit cards are accepted.

Following an order, email confirmation is sent to the email address provided at the point of ordering. This is an automated email service, therefore the customer must ensure to provide an accurate email address. Once payment has been made the order cannot be changed.

4.DELIVERY
In respect of private customers, delivery is carried out by Postnord, for collection at one of their pickup points, or in the case of smaller parcels, delivery to the customer’s letterbox. Postnord do not deliver at weekends. Deliveries are kept at the pickup point for 14 days before they are returned to us. Alternatively, orders may be collected at our premises at Rastaborgsvägen 12, 178 90 Ekerö.
We levy a fee, currently 250 SEK (including mervärdesskatt), for deliveries not collected from the Postnord pickup point within a maximum of fourteen (14) days, to cover our transport and administration costs.

For deliveries to a company, Postnord will deliver to the pickup point or the delivery address.

Outside Sweden Postnord cooperates with different freight companies.

Online orders received before 09.00 hrs Monday-Friday are usually dispatched from KILMANINSTITUTET AB on the same day. Orders are dispatched every day, except Saturday and Sunday. Goods delivered remain the property of FRIWAY AB until full payment has been received from the Buyer.

5.  DELIVERY COSTS
Delivery within Sweden: 70 SEK including tax (mervärdesskatt) for orders below 1 000 SEK.
Free delivery for orders of 1 000 SEK or above.
Delivery outside Sweden: 250 SEK including tax (mervärdesskatt), regardless of order amount.

6.  LATE PAYMENTS
Late payments incur annual interest of 20% of the outstanding amount from the due date together with a late payment fee of 60 SEK. Queries against an issued invoice must be made within ten (10) days.

7.  GOODS DAMAGED IN TRANSIT
The Buyer must check the goods received at the point of collection or delivery by Postnord. If the packaging appear damaged the goods must be unpacked and inspected. If the goods has been damaged in transit, the Buyer must immediately contact the carrier, Postnord, and seek reimbursement for the damages. The Buyer must then contact FRIWAY AB by telephone and provide the order number or invoice number and the complaint reference number from Postnord.

8.RIGHT TO RETURN (PRIVATE CUSTOMER)
As a private customer you have 30 days to return the product, providing it is returned unopened in the original packaging. A corporate customer does not have the right to return.

9.CANCELLATION RIGHTS (PRIVATE CUSTOMER)
A private customer has a statutory right (2005:59) with regard to sale of goods without face to face contact, to cancel the purchase within 14 days of receipt of the goods. The Buyer has the right to open and check the products. A corporate customer does not have cancellation rights.

In case of loss of value due to the opening of the packaging, FRIWAY AB will debit the buyer for the loss of value.  Products where the seal has been broken and where the products are not suitable for return due to health or hygiene reasons are excluded from the cancellation rights.

The Buyer should contact FRIWAY AB before the product is sent back to ensure smooth processing of the return. The Buyer should ensure the postage is paid for the item and enclose the invoice/return notice and if applicable the package should be marked with the return number. The products should be packaged carefully as it is the Buyer’s responsibility to ensure safe return and that the product is not damaged during the return transit. If the cancellation notice is approved, the full purchase amount is reimbursed including the original delivery cost within 14 days.

10.COMPLAINT
A private customer has the right to complain and return a product that was faulty on receipt. After three years from receiving the product, the right to complain is lost. The notification of the complaint must be given to FRIWAY AB within two months from discovering the fault. Faults that arise within 6 months of the purchase date are regarded as original. The terms and conditions of return are the same as for the cancellation rights. Faulty products that are returned to FRIWAY AB without approved outer packaging are returned to the customer without any remedial action as they are not approved under this policy.

Corporate customers must notify us of the fault as soon as it is discovered and within two weeks of delivery at the latest. Other than that the above rules are applicable.

11.FAULTY GOODS
If a product that FRIWAY AB is responsible for is faulty FRIWAY AB will address the fault by either repair, replacement or a refund.

FRIWAY AB’s responsibility with regard to faulty goods is limited to what is included within these terms and conditions for purchase and delivery and what is contained within consumer law.

The Buyer is entitled to reimbursement for costs incurred in connection with the faulty goods. The Buyer is also entitled to reimbursement for potential losses or more significant inconveniences in connection with the faulty goods or delays.

In order to obtain reimbursement the Buyer must show that the product is faulty or has been delivered too late and that the Buyer has suffered a loss as a result. The Buyer shall take reasonable precautions to limit losses and minimise the costs in connection with the complaint.

12.PERSONAL DATA
By registering and ordering from the Website the Buyer (if they are a person) gives their consent for FRIWAY AB to store and use their personal data in such a way as is outlined in our Privacy Policy for the Website.

13. COOKIES
In accordance with laws about electronic communication which came into force on 25 July 2003, all those who visit a website should be informed if the website is using cookies. If you visit our Website cookies are saved on your computer. These cookies are so called session cookies and are used to manage your login (if you are logged in) and your shopping basket when you are buying. Session cookies are not stored long term on your computer. They disappear when you turn off your web browser.

If you don’t accept the use of cookies you can adjust your web browser so that it automatically blocks cookies, or so that it informs you if a website uses cookies.  If you turn off cookies you will not be able to shop on our Website because the log in and shopping basket need to use cookies to be able to function. However, you can browse the Website without accepting cookies.
